<p>I think it’s one thing to build your own insanely dangerous exploration device and try it out yourself but to try to make money by selling people tickets for rides on it is far beyond mere “experimenting”. There’s also the very substantial public cost of rescuing the victims of these short-sighted ”experiments”.</p>

<p>I think it’s more along the lines of “learn from the experiences of others”. It’s my understanding that there are quite a lot of very smart people who have spent decades figuring out how to build these things relatively safely. This company decided to ignore the existing knowledge base entirely because what the industry had learned was expensive and inconvenient for a fledgling tourist company.<p>What’s that analogy about taking down a fence without understanding why someone put it up in the first place?</p>

<p>We can’t completely stop people from smoking either. But we can prevent people from starting and we can perhaps prevent those who have already started from increasing their consumption. Slowing down the rate of use by banning advertisements isn’t “hypocritical virtue signaling” it’s a real, measurable improvement. Perfection is the enemy of progress.</p>

<p>I don’t think he’s being sued at all. I think his blog post was cited as evidence in a lawsuit and so now Amazon’s lawyers are subjecting him to any and all discovery they can reasonably claim is even remotely related.</p>

<p>I’m not sure I follow why this is even a fact at issue? If Amazon policy applies a price floor to <i>all</i> Amazon sellers on <i>all</i> platforms they sell the product on then of course Amazon has caused higher prices for consumers elsewhere. Sure the policy has also probably resulted in lower prices for some products on Amazon but it seems undeniable that the external result would be higher prices on other platforms for some products.</p>

<p>What would be the motivation for a company to do this though? Trickery is not the way to win over new customers. The people buying these products <i>want</i> “not” milk. They’re specifically seeking out a product that <i>isn’t</i> milk. These companies have every reason to <i>highlight</i> the “not” rather than to hide it.</p>

<p>I feel like there are a lot of similar examples they just don’t get a lot of press. Naloxone was recently approved for OTC and they also recently approved allowing Mifepristone prescriptions by mail. They’re considering allowing a new birth control to be sold over the counter. Maybe a decade or so ago Plan B was prescription only but they allow that to be sold over the counter now, too.<p>And a lot of other drugs have made the jump in my adult memory: allergy drugs like Claritin and Flonase used to be prescription only as did just about every major antacid like Prilosec and Nexium. There’s a new topical NSAID for arthritis that recently made the switch to OTC too, I think.</p>
