There's a legal concept of 'waiver' meaning that even if something is prohibited in a contract, but the parties don't enforce that part, then that part is later not enforceable. Facebook was fully aware of this behavior, chose not to enforce the ToS, and therefore it waived that clause. Therefore no breach.

I used to subscribe to Green Chef, but stopped mostly due to the time it takes to make the meals. Usually it took twice as long as it said on the recipes.

We now subscribe to Freshly. Meals are pre-made and in 3 minutes they are heated up. Perfect!

I wouldn't think of someone as "horrible" for not caring what color other people's skin is. That's a testament to the world we're in. If you don't actively and consciously take skin color into consideration, you're a bad person!
