It doesn't say you can't sue them, it just says you must use binding arbitration when you do, which means you can't have an official judge or jury... a single neutral third-party (usually a lawyer or retired judge) becomes both the judge and jury, and their decision is final.

I think the incentive for them is that arbitration cases are usually harder for consumers to win, and/or the case gets resolved much more quickly than going through the traditional court system. I would imagine things like huge punitive damages or class-action suits are a lot harder (or impossible) to have as well.

My understanding is that IF they are tracking your historical movements over time from multiple different cameras, that constitutes a "search" and the Fourth Amendment requires a warrant in that case.

There have been slightly different variations to this in the courts lately, such as google location history and geofence warrants, but unless you know of a legal precedent (besides "they're getting away with it right now") that says historical movements don't need a search, I'm inclined to believe that they do.

Whether or not that is currently being successfully tested in court is another story.

But don't underestimate human adaptability. Slippery slope arguments assume that once a technology introduces a specific risk, society lacks the agency to create counter-measures, new norms, or alternative uses for that technology.

I haven't found that to be the case throughout most of history.
